Terms of Service

1. Agreement to Terms
By accessing or using services provided by Frisky Developments LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Services
Frisky Developments LLC provides boutique IT operations services including but not limited to:
- Infrastructure architecture and cloud-native systems
- Product engineering and full-stack development
- Brand systems and design identity
- Operational intelligence, monitoring, and security auditing
- SaaS platform development and management
3. Client Obligations
Clients agree to provide accurate information, timely feedback, and necessary access credentials required for service delivery. Clients retain ownership of their data, code, and intellectual property unless otherwise agreed in writing.
4. Payment Terms
Payment terms are specified in individual service agreements or invoices. Payments are processed securely through Stripe. All fees are non-refundable unless otherwise stated in the specific service agreement. Late payments may result in service suspension after 15 days notice.
5. Intellectual Property
Upon full payment, clients receive full ownership of all custom code, designs, and deliverables created specifically for their project. We retain ownership of our pre-existing tools, frameworks, and internal systems used in service delivery.
6. Confidentiality
We treat all client data, credentials, and business information as confidential. We do not share, sell, or disclose client information to third parties except as required to deliver the contracted services or as required by law.
7. Limitation of Liability
To the maximum extent permitted by law, Frisky Developments LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the total fees paid by the client in the 12 months preceding the claim.
8. Service Level
We strive for 99.9% uptime for managed infrastructure services. Specific SLAs are defined in individual service agreements. Scheduled maintenance windows are communicated 48 hours in advance.
9. Termination
Either party may terminate services with 30 days written notice. Upon termination, we will provide a complete handoff of all client assets, credentials, and documentation. Pre-paid fees for unused service periods will be refunded on a pro-rata basis.
10. Governing Law
These terms are governed by the laws of the State of New Mexico, United States. Any disputes shall be resolved in the courts of New Mexico.
